These Terms and Conditions apply to all transactions made through our website between yourself and us. They do not affect your statutory rights. Please read them carefully.

These Terms and Conditions are governed by English law and are subject to the non-exclusive jurisdiction of the English courts. We do not accept amendments to these Terms and Conditions.
Failure by us to enforce any of these Terms and Conditions will not affect our right to enforce the rest of these terms and conditions.
Acceptance of order
The contract in respect of the products supplied by us to you comes into existence when your order has been accepted by us. For the avoidance of doubt, receipt of an order via our site does not constitute acceptance of an order.
Your right to Cancel
You have the right to cancel your order with us at any time before the expiry of 7 days from the day after the date of delivery.
Please note that if your order has been processed we are unable to cancel it and therefore return costs at your expenses.
Delivery
All deliveries take between 1-3 working days
If no one is at home when our courier (UPS) tries to attempt delivery, then UPS will make two further attempts on the following days to deliver the consignment. If delivery cannot be made during these three attempts then UPS will return the goods to the sender (baby-nest.co.uk). We will then wait for you to contact us, to decide if the consignment is still wanted or not, before we refund your money minus the return of package cost.
In cases where a delivery has been refused. The consingment is returned to the sender (baby-nest.co.uk). We will then wait for you to contact us, to decide if the consignment is still wanted or not.
We will only deliver goods to the address on the order .
Wrong Delivery Inputted
If you provide us with a wrong delivery address and your goods are signed for by another party, baby-nest.co.uk cannot be held responsible for any loss you incur as a result.
Returns
You may of course return any items purchased from baby-nest.co.uk within 21 days, please get a returns number within 7 days of purchase by emailing us at enquiries@baby-nest.co.uk.
Please note we cannot refund monies if we have not issued a returns number, therefore, please ensure you get a returns number. Return costs are at your expense.
Product Guarantee
All items purchased from baby-nest.co.uk are covered by a 12 month guarantee.
We will exchange or repair any product if it displays a manufacturing fault within 28 days.
If it displays a manufacturing fault after 28 days, but within the guarantee period, we will repair or send spare parts to you free of charge.
Accidental damage and damage caused by misuse is not covered by this guarantee and therefore a charge will be made. If you have damaged any of your nursery items, you may be able to make a claim against your households contents insurance.
This warranty does not affect your statutory rights.
Guarantee Summary Charges
0-6mths - Manufacturing faults will be repaired or replaced free of charge
0-6mths - Accidental damage, misuse or general wear & tear - £29.25 admin handling charge plus any repair charge if applicable.
6-12mths - Parts and labour will be supplied free of charge, however, an administration & charge of £29.25 will be charged plus any repair chare if applicable.
6-12 mths - Accidental damage, misuse or general wear & tear are not covered and a £40.00 adminstration and handling charge will apply.
12-24mths - Parts and labour £45.00 + £29.25 admin and handling - we reserve the right to reject any product for repair if it is beyond economical repair.
The admin handling charge of £29.25 will be charged after inspection to the paying card of the original order; if the goods are suffering from accidental damage, misuse or general wear & tear. We will then return the goods to the address from where the collection was made.
Please note we reserve the right to reject items that are uneconomical for repair or are in an unsutiable condition. Please note any repairs made will not extend the original guarantee of the product. This does not affect your statutory rights in the event of faulty goods.
All products which require repair outside the their guarantee period will be quoted for individually ** All parts are supplied subject to availability.
Specifications, Colours, Weights & Sizes
We reserve the right to alter specifications without prior notice. All sizes and weights are given as a guide only and are approximate. Representations of colour are approximate due to limitations of photographic and calibration of different output devices. A name given to a product is not necessarily representative of the colour - for example Steel Blue is actually Red. All goods are subject to availability. If sold out, free offers may be substituted with an item of the same value. Accessories supplied to co-ordinate with the main product may differ in shade; this is normally caused by the manufacturing process and is not a fault.
Wood is a natural product and the grain and finish will vary from piece to piece. Manufacturers normally use different grades of woods for items such as cots or cot beds, and, therefore the finish can appear differently.
Customer Orders
We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.
To order goods over the telephone or on our website, you must be at least 18 years of age and accept delivery within the UK . All telephone orders will be acknowledged verbally at the time of order, and all orders placed on our website will be acknowledged electronically by e-mail. Please note that verbal and/or electronic acknowledgements do not constitute order confirmation or order acceptance. Your order will be accepted and the creation of a legally binding contract between you and us will take place once the goods have been despatched or collected. (Alternatively, we may decline all or part of your order for any reason, in which case we will inform you in-person or by telephone or e-mail).
When deciding whether or not to accept your order we may use certain information about you, including any received from credit reference agency checks. This helps to protect you and us against fraudulent transactions.
We will tell you if your payment details cannot be authorised for any reason and may invite you to pay by another method.
All orders need to be received by 3pm so that the goods may be sent the same day.
Prices
The total price payable will be stipulated at the time when you place your order whether or not the order has been acknowledged. We are entitled to make adjustments to the price to take account of any increase in our suppliers’ prices, or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether or not the order has been acknowledged. We will inform you of the correct price and give you the opportunity to cancel the order. All prices are inclusive of VAT (where applicable) but exclusive of delivery charges which may be payable as indicated at the time the order is placed.
From time to time the prices displayed on our website may be different if you are directed to it from a third party website. Purchases at these prices can only be made on our website and by arriving on it through a relevant third party website; these prices will not be available in-store or over the telephone.
Prices, offers and products are subject to availability and may change before (but not after) we accept your order. If a product becomes unavailable we may offer you an alternative.
Although we endeavour to ensure that all pricing information on the website is accurate, occasionally an error may occur and goods may be mispriced. If we discover a pricing error we will, at our discretion, either: contact you and ask you whether you wish to cancel your order or continue with the order at the correct price; or notify you that we have cancelled your order. We will not be obliged to supply goods at the incorrect price.

Order Processing
Your order is sent directly to our secure till in our shop for processing. Once we have received your order and payment, our staff will pick, pack and dispatch the item. We will aim to do this the same day for all orders received before 2.30 pm UK time, Monday to Friday, excluding Bank Holidays.
Order Cancellation
You can cancel your order at any time before it is dispatched (usually by 3.30 pm UK time). If your card has already been charged, we will aim to credit your account with the full amount within 48 hours.

Security
We use the industry leading internet payment company Sage Pay to protect your card details and protect us from fraud. The following security systems are used:
Transaction security.
All transaction information passed between merchant sites and the Sage Pay VSP Systems is encrypted using 128-bit SSL certificates. No cardholder information is ever passed unencrypted and any messages sent to your servers from Sage Pay are signed using MD5 hashing to prevent tampering. You can be completely secure in the knowledge that nothing you pass to the Sage Pay servers can be examined, used or modified by any third parties attempting to gain access to sensitive information.
Encryption and Data Storage.
All sensitive data is secured on Sage Pay using the same internationally recognised 256-bit encryption standards used by, among others, the US Government. The encryption keys are held on state-of-the-art, tamper-proof systems in the same family as those used to secure VeriSign’s Global Root certificate, making them all but impossible to extract. The data we hold is extremely secure and we are regularly audited by the banks and banking authorities to ensure it remains so.

Sage Pay has multiple private links into the banking network that are completely separate from the Internet and which do not cross any publicly accessible networks. Any cardholder information sent to the banks and any authorisation message coming back is secure, and cannot be tampered with.
Employee access.
No individuals within Baby Nest or Sage Pay are able to decrypt transaction information or cardholder data. Our systems only allow access to our most senior staff and only in extenuating circumstances (such as investigations of Card Fraud by the Police). Your transaction information and customer card information is secure even from our own employees because our systems never display the full card numbers, even on administration screens.
Privacy Policy
Baby Nest is committed to protecting your privacy. We will only use information given at the time of ordering or when making an enquiry by whatever means is collected lawfully and in accordance with the Data Protection Act 1998.
We do not pass your personal information on to third parties.
All transactions that you initiate with Baby Nest on this web site are confidential. Your name will not be added to any third party mailing lists.
